JUST IMAGINE TERMS + CONDITIONS

These Terms and conditions (“Terms”) outline the conditions under which Just Imagine (“the Company”) provides rental items and related services to the Client (“the Client”), as detailed on the quotation. By signing below, the Client confirms understanding and acceptance of these Terms.

1. GENERAL TERMS

• All rental items remain the sole property of Just Imagine.
• Rental items are accepted in “as-is” condition. The Client acknowledges that items may show signs of prior use and agrees that such wear does not impact their intended function or presentation, nor does it affect the production value of the items.
• Just Imagine reserves the right to decline service or cancel any rental agreement at its sole discretion for reasonable cause.
• Just Imagine agrees to rent to the Client the items described in detail in the Rental Quotation
• The Client agrees to pay Just Imagine the fees specified in the Rental Items List, along with any applicable delivery charges or other charges stated therein.
• Rental Fees apply for the time the rental items are reserved or out of Just Imagine’s possession, regardless of whether the items are actually used by the Client.
• No refunds will be issued for unused rental items.
• All rentals are daily rentals, not 24-hour rentals. Standard rental service includes same-day delivery and same-day pick-up unless otherwise scheduled and agreed upon in writing.

Client responsibility

• The Client is responsible for obtaining all necessary permissions from the venue for the setup and use of rental items, including but not limited to: adequate space, shelter, and power supply. Just Imagine does not supply extension cords or adapters unless otherwise agreed.
• The Client is responsible for ensuring all access points (gates, doorways, elevators) are sufficient in size to allow safe movement of items. Item dimensions are available upon request. Just Imagine is not liable for property damage if access is inadequate.
• The Client is responsible for providing vehicle access and parking near the venue entrance, and a minimum two-hour window before and after the event for setup and retrieval.

2. DELIVERY & WILL-CALL

Delivery Services

• Delivery, installation, and retrieval are available and will be scheduled based on order size, logistical complexity, and location. These fees are not included in the base rental pricing.
• Delivery and Collection fees start at $160.00 roundtrip and increase depending on event requirements.
• Delivery and collection will occur within a mutually agreed window of time.
• If Just Imagine’s team arrives within the scheduled delivery/pick-up window and is unable to retrieve items, an additional next-day pick-up fee will apply.
• A mandatory rush fee of the greater of 25% or $25 will apply to all delivery orders placed within 3 days of the event date.

Will-Call (Client Pickup)

• Select rental items are available for client pickup and return.
• A 15% damage waiver is available and recommended for Will-Call orders.
• Larger or fragile items may not be eligible for Will-Call. Eligibility will be confirmed prior to booking.
• A mandatory rush fee of the greater of 25% or $25 will apply to all Will-Call orders placed within 3 days of the scheduled pickup date.
• Failure to drop-off the order by the agreed time on the return date will result in a late fee.
• Clients are solely responsible for the safe transportation and return of all rental items.
• The Client will be liable for the full replacement cost of any item lost, damaged, destroyed, or not returned

3. LABOUR FEES

• Labour fees may apply for services related to the setup, styling, and takedown of rental items.
• Labour fees are quoted based on the scope, complexity, and timing of the setup and takedown requirements.
• If labour fees have been paid, and Just Imagine’s team is unable to access the site on no fault of their own, these fees will not be refunded.
• Delays caused by inaccessible sites, venue restrictions, or client readiness may incur additional labour charges billed at the prevailing hourly rate; these will be discussed with the client prior to billing.
• If labour is required beyond the original quote due to changes or on-site conditions, the Client is liable to be invoiced for the additional work accordingly; this will be discussed with the client prior to completing the work.

4. RENTAL CARE & USE

Outdoor Use

• Select items may be used outdoors. The Client is responsible for ensuring adequate protection from adverse weather conditions. If weather conditions are unsafe, Just Imagine reserves the right to delay or modify the installation.

Weather-related damage may result in replacement charges of up to five (5) times the rental value.
Return Condition Requirements

All rental items must be returned in the following condition:

Surfaces must be free of food residue, wax, or other substances.
Plates and dishware must be scraped and, where possible, rinsed prior to return.
Linens must be shaken free of debris, dried (if wet), and returned in the provided laundry bags.
Items returned in an excessively soiled condition may incur a cleaning fee.

4. DAMAGE, LOSS, AND LIABILITY

The Client agrees to return all rental items in the condition in which they were received, except for normal wear and tear. The Client understands that they will be charged to cover the cost of repairing or replacing damaged or lost items based on current market value and the impact of the loss on future rentals.

Damage Waiver

A 15% optional damage waiver covers minor wear and tear. This waiver does not cover:

Negligence or misuse
Water or weather-related damage
Broken or missing items
Items exposed to conditions outside of their intended use

Damage Assessment

Items will be assessed within three (3) days of return. Documentation, including photos when available, will be used to determine the condition and any applicable charges. All visible damage will be photographed on site whenever possible. Replacement costs will reflect current market value and the impact of the loss on future rentals.

Liability

The Client assumes full responsibility for the safety of the event venue, its furnishings, and attendees. The Client is liable for any injury, loss, or damage to Just Imagine personnel, rental items, or third-party property caused by guests, vendors, or venue staff not employed by Just Imagine.

5. BESPOKE ITEMS

• A 10% creative concept development fee (minimum USD $60.00) applies to all custom designed orders and is non-refundable.
• A non-refundable deposit is required before production begins to secure your booking and initiate any custom work. The deposit will be applied to the booking fee thereafter.
• If there is cancellation after the booking is confirmed, there will be an added cost to The Client to cover materials already purchased.
• Cancellations made within three (3) weeks of the scheduled delivery or pickup date will result in full item charges.

6. PAYMENTS & INVOICING

A non-refundable deposit, as specified in the quotation or invoice, is required to secure your booking. Failure to pay by the agreed date will result in cancellation without notification.

• All prices exclude GST and delivery unless otherwise stated.
• Rental rates apply only for the agreed rental period. Extensions must be approved in writing.
• Final payment is due on the date specified in the invoice.

Order Confirmation and Modifications

• The rental agreement becomes binding once payment is made and the Client has agreed to the terms and conditions outlined herein.
• There is a 24-hour window for permissible cancellations which begins immediately after payment.
• Cancellations made after this 24-hour window will result in forfeiture of the deposit. However, the client will receive a store credit valid for one (1) calendar year from the original booking date.
• Once the client has paid the 50% deposit, they may make final changes to the order up to two (2) weeks before the event date.
• Changes may not decrease the total order value by more than ten percent (10%).
  Late Payments

Payments not received within seven (7) days of the due date are subject to a 2% daily interest charge, unless otherwise agreed in writing.

7. CANCELLATIONS & LATE RETURNS

Cancellations

Cancellations made less than three (3) days before the scheduled pickup or delivery will result in full rental charges.
Cancellations of bespoke items made less than three (3) weeks before the scheduled delivery or pickup will result in full item charges.

Late Returns

• Rental items must be returned by the agreed-upon date and time. Late returns will incur the full daily rental fee for each day late, up to fourteen (14) days, after which added full replacement charges may apply.

8. RESCHEDULING EVENT DATE

• If the Client reschedules the event date, written notice must be provided to Just Imagine as soon as possible.
• The Client should include the new proposed date, if known
• Just Imagine does not guarantee the availability of rental items for the Rescheduled Event Date.
• If the items are available, the Client may incur additional fees resulting from the rescheduling.

 

9. SUBSTITUTION POLICY

In the event that a rented item becomes unavailable due to damage, loss, or other unforeseen circumstances, Just Imagine reserves the right to substitute the unavailable item with another item of similar style, quality, and value. Clients will be notified of any substitutions prior to delivery whenever possible.

10. FORCE MAJEURE

Just Imagine shall not be held liable for failure to perform its obligations under this Agreement due to circumstances beyond its reasonable control. These include, but are not limited to: acts of God, natural disasters, fire, flood, severe weather, governmental actions, labour disputes, pandemics, or supply chain disruptions. In such cases, the Client’s deposit may be transferred to a rescheduled event date at the discretion of the Company but is otherwise non-refundable.

11. PHOTO & MARKETING RELEASE

Unless otherwise stated in writing by the Client, Just Imagine reserves the right to photograph rental setups and use such images for marketing purposes, including but not limited to website galleries, social media, and promotional materials. No identifying images of individuals will be used without separate consent.

12. LIMITATION OF LIABILITY

Just Imagine’s total liability for any claim arising out of or relating to this Agreement shall be limited to the total fees paid by the Client for the rental and services in question. The Company shall not be liable for any indirect, incidental, or consequential damages.

13. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Anguilla, and any disputes shall be resolved under the exclusive jurisdiction of its courts.
